Thriller - Novel What is a Copyright?

While writing, I was wondering about the copyright process. After doing some research, I realized that I needed a registered copyright. That decision begins with an understanding of what the difference between a copyright and a registered copyright. So what is a copyright?

Copyright is a form of protection grounded in the U.S. Constitution and granted by law for original works of authorship fixed in a tangible medium of expression. Copyright covers both published and unpublished works. I view it as a literary patent.

Huh? What is that gibberish in the last sentence? Read on...

What is a Registered Copyright?

Copyright exists from the moment the work is created. You will probably have to register, however, if you wish to bring a lawsuit for infringement of a U.S. work. If that is important to you, you should get legal advice cuz I'm not a laywer.

Registration is recommended for a number of reasons. Many choose to register their works because they wish to have the facts of their copyright on the public record and have a certificate of registration. Registered works may be eligible for statutory damages and attorney's fees in successful litigation.

Why did I register my work?

While a copyright exists the moment the work is created, it is my understanding that without a registered copyright; I have limited recourse if someone violates the copyright. The registered copyright enables me to bring a lawsuit for infringement and the work may be eligible for damages. For just a few dollars, an effort spanning many, many years is protected.

It is also worth noting that there are multiple iterations of this work that goes back several years. The registered copyright is also helpful here. "..., if registration occurs within five years of publication, it is considered prima facie evidence in a court of law."

Neckline, Betrayed, Betrayal, and The Moral Conundrum are examples. The Moral Conundrum was the final selection for the print.
